- Articles of Organization: $35. Once, when you form the LLC. $35.00 plus $50.00 per series member for a series LLC (not applicable to a standard LLC). Source
- Annual Report: $20. Every year, starting in year 2. Standard on-time fee set by ARM 44.5.115(3)(d) is $20: official MAR Notice 44-2-276 (2024) says about 189,000 LLCs save $3,780,000 when that fee is waived, which is $20 each. ARM 44.5.303 waives it for reports filed January 1 to April 15. The state waived it for on-time filers in 2024, 2025 and 2026 and has announced the waiver again for 2027. After April 15 the fee is $35 (sosmt.gov/business/fees). Under MCA 35-8-208(3) the first report is due January 1 to April 15 of the year after the calendar year the LLC is organized. Source
Forming in another state instead?
If your business operates in Montana, forming in another state does not remove the Montana fees. You register there as a "foreign" LLC ($70) and keep filing its yearly reports. You also pay a registered agent in the other state. We assume $99 a year, a low published price (Harbor Compliance).
