Each fee
- Articles of Organization: $100. Once, when you form the LLC. SOS Fee Schedule, effective November 18, 2019 (Domestic LLC $100). A fee waiver for veteran-owned businesses was seen in search results but not confirmed. Source
- Annual Report: $25. Every year, starting in year 2. SOS annual reports page (re-read 2026-10-09): W. Va. Code 59-1-2a requires the '$25.00 filing fee between January 1 and June 30 of each year following the calendar year in which the business was registered'. The first report is therefore due in the calendar year after formation (year 2). Source
Forming in another state instead?
If your business operates in West Virginia, forming in another state does not remove the West Virginia fees. You register there as a "foreign" LLC ($150) and keep filing its yearly reports. You also pay a registered agent in the other state. We assume $99 a year, a low published price (Harbor Compliance).
